The article considers the nature of legalistic, or formal, conceptions of the rule of law, focusing particularly on the work of Joseph Raz and Albert Venn Dicey. It asks how such apparently narrow conceptions are generated, and how far they can resist including broader social claims. It concludes that the rationale behind legalistic conceptions compels them to address issues of poverty and the literacy of the law's subjects. Using student self-reported cheating admissions and answers from a hypothetical cheating scenario, this paper analyzes the effects of individual and situational factors on potential cheating behavior. Results confirm several conclusions about student factors that are related to cheating. The probability of cheating is associated with younger students, lower GPAs, alcohol consumption, fraternity/sorority membership, and having cheated in high school. Student perceptions of the certainty and severity of punishment appear to have a negative and significant impact on the probability of cheating (...) on in-class assignments. Students who report a belief that cheating is never acceptable appear to be significantly less likely to cheat in any circumstance. This study illustrates the context-dependent nature of academic dishonesty, and the associated difficulty in understanding the relationships between measurable factors and cheating behavior. It is where he most directly asks "what philosophy can and cannot contribute to the project of making sense of things"--answering that what philosophy can best help make sense of is "being human." We all ‘know’ that public opinion came to prominence in the political vocabulary of the late eighteenth century. It may be that this dates its rise a bit late, but it is not relevant to argue the matter here. My concern is rather that we be equally aware of the purposes for which people made use of the concept. Here I wish to consider various possible contexts for speaking or writing of public opinion, or ‘opinion’, as it was usually called (...) prior to the mid-eighteenth century. It may be possible to define, more fully than heretofore, the work that the expression did in eighteenth-century thought. As contemporary students of public opinion have been learning, an answer to this question may not even be wholly irrelevant to the task of specifying the nature of public opinion in our own time. I shall argue that the central doctrines of Locke's politics have a theological basis, a doctrine of Creation similar to the Thomist one. Locke does not elaborate this doctrine; he presupposes it. It is not a hidden, esoteric element in his thought; it is there on the surface, but in a scattered and fragmentary form.I shall proceed in this fashion: First, I shall set out this doctrine of Creation and show its connexion with Locke's moral theory by way of an (...) examination of his doctrines of property and power. The revival of interest in Carnap’s philosophy over the past two decades has shed much light on particular aspects of his intellectual development and its context. We now have a better appreciation of the background and motivation of the Aufbau. 1 The radical nature of the Syntax program has fmally, more than half a century after its first publication, begun to be acknowledged.2 And the later Carnap has also been re-assessed; the previously widespread impression that Quine was “right” and Carnap (...) “wrong” in the analytic-synthetic debate has yielded to a more balanced view3, and the broad outlines of Camap’s late philosophy have begun to emerge. The Society for Unification Psychology was formed by a group of psychologists concerned about the growing issues of diversity and fragmentation in psychology. The Society held its first organizational meeting at the 1985 APA convention. It is intended that SUNI will become a special interest group of APA's Division 24, Theoretical and Philosophical Psychology. The Society's purpose is to stimulate discussion of issues of unity and disunity in psychology by: planning symposia and other presentations at APA and related conventions; conducting (...) A special issue on ‘Private Autonomy and Public Paternalism’ constitutes the first part of this issue. Guest-editors are Annette Dufner and Michael Kühler, both from the University of Munster, Germany. It is often assumed that personal autonomy is a ‘private’ matter in the sense that it is based primarily on a person’s subjective characteristics and capabilities. At the same time, the literature mainly deals with paternalism as a problem of the ‘public’ sphere, for example by focusing on the dangers that (...) threaten the autonomy of individuals as citizens, such as state paternalism. However, it is widely acknowledged nowadays that personal autonomy can only develop and flourish if conditions in the social and relational sphere are favourable, which means that personal autonomy is not so private after all. At the same time, it should be clear that paternalism not only relates to our behaviour in the public sphere, but also to how we behave in more private social spheres, like family, frien. (shrink)
